Facebike.nl – webshop and in-store consumer sales

Article 1 – Identity of the trader

Article 2 – Applicability

These general terms and conditions apply to every offer made by Facebike.nl and to every agreement concluded with a consumer through the webshop and, where relevant, in the physical store.

Any deviations from these terms are valid only if confirmed by Facebike.nl in writing or electronically.

If any provision is null, void or unenforceable, the remaining provisions shall remain in full force and effect.

Article 3 – The offer

Facebike.nl describes products, accessories, used bicycles and parts as clearly and completely as reasonably possible.

Obvious mistakes, clerical errors or pricing errors in product information, prices or images are not binding on Facebike.nl.

Images, colours, sizes, weights, ranges, delivery times and technical specifications are indicative; limited deviations may occur.

Used or second-hand products may show signs of use. Known material characteristics and visible deviations will be disclosed as far as reasonably possible.

Article 4 – Conclusion of the agreement

The agreement is concluded when the consumer accepts the offer and complies with the conditions attached to it.

After the order has been placed, the consumer will receive an electronic order confirmation.

Facebike.nl may refuse an order or attach additional conditions to its performance where there is a reasonable ground to do so, including incorrect data, payment issues, obvious pricing errors or lack of stock.

Article 5 – Prices and payment

All consumer prices shown on the website include VAT unless explicitly stated otherwise.

Any delivery charges, assembly charges, handover charges or other additional costs will be clearly stated before the order is completed.

Payment shall be made using the payment methods offered on the website.

Until full payment has been made, ownership of the delivered goods remains with Facebike.nl to the extent permitted by law.

Article 6 – Delivery and performance

Facebike.nl will process orders with due care.

Delivery shall take place at the address provided by the consumer unless otherwise agreed in writing or electronically.

Stated delivery times are indicative unless explicitly agreed otherwise.

If no specific delivery period has been agreed, consumer orders will in principle be delivered within 30 days.

The risk of loss of or damage to the products remains with Facebike.nl until the moment of delivery to the consumer, unless the consumer has chosen a carrier not offered by Facebike.nl.

Article 7 – Right of withdrawal for distance contracts

For distance contracts, the consumer generally has the right to withdraw from the agreement without giving reasons within 14 days after the product has been received by the consumer or by a third party designated by the consumer.

The consumer must clearly notify Facebike.nl of the withdrawal within this period.

After giving notice of withdrawal, the consumer has a further 14 days to return the product.

During the withdrawal period, the consumer must handle the product and its packaging with care. The product may only be used or inspected in the same way as would be possible in a physical store.

If the product has been used beyond what is necessary to establish its nature, characteristics and functioning, Facebike.nl may charge a reasonable amount for the diminished value.

The right of withdrawal does not apply to custom-made, personalised or otherwise legally excluded products.

Article 8 – Return costs and refunds

Unless Facebike.nl expressly states otherwise in advance, the direct costs of returning the goods shall be borne by the consumer.

For bicycles and other large or bulky items that cannot normally be returned by ordinary post, Facebike.nl will clearly inform the consumer before conclusion of the agreement whether and which return costs are payable by the consumer.

If Facebike.nl fails to provide that information in advance where required by law, such return costs shall be borne by Facebike.nl to the extent required by law.

Facebike.nl will refund amounts that must be repaid under the law as soon as possible and no later than 14 days after receiving the notice of withdrawal. Facebike.nl may withhold reimbursement until the returned product has been received or until the consumer has supplied proof of return shipment, whichever occurs first.

Refunds will be made using the same means of payment as used for the original transaction unless expressly agreed otherwise.

Article 9 – Legal guarantee and complaints

Facebike.nl guarantees that products conform to the agreement, to the reasonable expectations a consumer may have and to the legal requirements applicable at the time of delivery.

Any commercial guarantee provided by Facebike.nl, the manufacturer or the importer does not affect the consumer’s statutory rights.

In the event of a complaint relating to a defect, non-conformity or transport damage, the consumer must first contact Facebike.nl. Facebike.nl will not simply refer the consumer to the manufacturer.

If a complaint is well-founded, Facebike.nl will offer an appropriate remedy within a reasonable period, such as repair, replacement, price reduction or refund, to the extent required by law.

Complaints concerning performance of the agreement should be submitted to Facebike.nl as soon as possible, fully and clearly described, by e-mail or by telephone.

Article 10 – Repairs, service and used products

Additional service terms may apply to repairs, workshop services and assembly work; these will be communicated to the consumer in advance or when the bicycle or part is handed in.

For used bicycles and used parts, the characteristics and visible condition are those described in the offer or those that could reasonably have been observed by the consumer at the time of purchase.

Normal wear and tear, ordinary signs of use and maintenance-sensitive components are not automatically covered by a commercial warranty, without prejudice to the consumer’s statutory rights.

Article 11 – Liability

Facebike.nl is not liable for indirect damage, consequential loss, loss of profit, loss of savings or business interruption, unless caused by intent, deliberate recklessness or unless mandatory law provides otherwise.

To the extent permitted by law, any liability of Facebike.nl is limited to the amount paid out under the applicable liability insurance or, if no payment is made, to the invoice value of the relevant order or service.

Nothing in these terms limits rights of consumers that cannot be excluded or restricted under mandatory law.

Article 12 – Privacy

Facebike.nl processes personal data in accordance with applicable privacy legislation and the privacy statement published on the website.

The privacy statement applies in addition to these terms where personal data are processed in connection with orders, contact requests, service requests or newsletters.

Article 13 – Governing law and disputes

Dutch law exclusively applies to agreements between Facebike.nl and the consumer.

Disputes should preferably first be resolved amicably.

To the extent permitted by law, disputes shall be submitted to the competent court in the district where Facebike.nl is established, without prejudice to the consumer’s right to bring a claim before another competent court where mandatory consumer law so provides.

Article 14 – Purchases in the physical store

For purchases made exclusively in the physical store, there is no statutory right of withdrawal unless the law provides otherwise.

Any voluntary exchange or return policy for in-store purchases applies only if and to the extent that Facebike.nl expressly offers such a policy.
