1. General provisions

1.1.  Facebike NL provides an additional 24-month commercial seller’s warranty for a new electric bicycle, starting on the date the bicycle is delivered to the consumer.

1.2.  This commercial warranty is an additional commitment, separate from the consumer’s statutory rights under Dutch law (legal conformity). Dutch statutory protection does not have a single fixed expiry date and may extend beyond 24 months.

1.3.  These terms apply to consumers purchasing a new electric bicycle from Facebike NL. The seller’s identity, delivery details and the particular bicycle are recorded on the sales invoice and/or warranty certificate.

1.4.  The bicycle must be used normally and in accordance with the manufacturer’s instructions. The buyer is informed of the maintenance schedule and relevant operating instructions.

2. What the commercial warranty covers

2.1.  During the 24-month period, Facebike NL will remedy, free of charge, faults covered by this commercial warranty which have not been caused by normal wear, misuse, an accident or demonstrable external damage.

2.2.  Coverage includes manufacturing and material defects in the frame, fork and non-wear mechanical components and the original electric drive system, such as motor, controller, display, sensors, wiring and battery, unless a more favourable separately documented policy applies.

2.3.  Normal battery capacity reduction due to age and use is not in itself a defect. Abnormal malfunction or premature failure will be assessed individually without prejudice to statutory rights.

2.4.  Repair or replacement will follow applicable statutory rights. For non-conforming goods, the statutory remedy is free of charge, including necessary labour, parts and other costs that the seller must bear.

3. Mandatory free initial inspection — days 25 through 45

3.1.  Facebike NL requires the buyer to present the bicycle for a free initial inspection (first service) between calendar day 25 and day 45 after purchase/delivery. If the purchase and delivery dates differ, the delivery date will be used for this schedule.

3.2.  For this scheduled service, the buyer must bring the bicycle to the Facebike NL store at their own initiative. An appointment must be made in advance; the inspection itself is free.

3.3.  The initial service includes a general safety check, inspection and adjustment as needed of brakes, gears, bolts, wheels and tyres, plus a basic check of electric assistance and visible connections.

3.4.  Replacement of wear items or additional work outside this free inspection is carried out only after a quotation and the buyer’s prior approval, unless Facebike NL must provide it free under warranty law.

3.5.  If the buyer cannot attend during this period or the store has no available appointment, the buyer should contact Facebike NL promptly to arrange an alternative date. Delays attributable to Facebike NL will not be held against the buyer.

3.6.  This service is mandatory under the Facebike NL recommended maintenance programme. However, failure to attend does not automatically cancel statutory rights. A warranty claim may be declined only insofar as a specific defect is demonstrably caused by a failure to perform necessary maintenance and the law permits such refusal.

4. Mandatory paid services at one and two years

4.1.  The buyer must present the electric bicycle for scheduled maintenance around 12 months and again around 24 months after delivery. Appointments should be booked in advance. These services are chargeable.

4.2.  The standard price for each annual service is €85 including VAT, both for the first-year service and the second-year service.

4.3.  The €85 price covers only the customary inspection, checks, adjustments and basic diagnostics included in the standard service. Parts, consumables, extra repairs and work outside the standard service package are not included.

4.4.  Any extra charges will be itemised beforehand and the work will proceed only with the buyer’s approval. No charge will be made for work that the seller is obliged to provide free under statutory or applicable commercial warranty.

4.5.  These services form part of the prescribed maintenance programme. Missing or declining a paid service does not automatically remove statutory conformity rights. Any causal link between missed maintenance and specific damage must be assessed individually.

5. Wear items and excluded causes

5.1.  The commercial warranty does not cover normal wear or routine replacement of items such as brake pads, brake discs worn through use, cables, chain, cassette, sprockets, tyres, inner tubes, grips, saddle coverings, lubricants and other consumables.

5.2.  Commercial cover also excludes damage caused by collisions, falls, overloading, incorrect assembly or modifications, unauthorised tuning, improper charging, unsuitable storage or use contrary to manufacturer instructions, to the extent such conduct caused the damage.

5.3.  An electric bicycle may be used in ordinary rain within the protection limits stated by the manufacturer. Water damage caused by immersion, pressure washing or improper prolonged damp storage may fall outside commercial cover when this is demonstrably the cause. Preferably keep the bicycle and battery in a dry, enclosed area.

5.4.  These exclusions do not restrict the consumer’s right to a free remedy where the bicycle fails to conform to the contract under normal use.

6. Claims and handling

6.1.  Report faults promptly to [email protected] or in store, providing proof of purchase, a description and photos or video where possible.

6.2.  Facebike NL will inspect the complaint and explain the next steps. Any repair or replacement required by statutory warranty will be free, within a reasonable time and without significant inconvenience.

6.3.  For routine paid services the buyer brings the bicycle to the store. This does not limit the consumer’s entitlement to free remedies and transport costs where Dutch consumer law requires the seller to cover them for a valid warranty claim.

6.4.  For work outside warranty, the buyer will receive a quote in advance. No inspection fee will be charged where prohibited by law.

7. Statutory rights

7.1.  The buyer retains all mandatory statutory rights under Dutch consumer sales law alongside this commercial warranty. Those rights remain after this commercial warranty expires and are not restricted by these terms.

7.2.  If goods do not conform to the contract, the buyer may, subject to the legal requirements, be entitled to free repair or replacement and in certain cases a price reduction or termination of the sale.

7.3.  A maintenance requirement, service charge, exclusion or purchase acknowledgement cannot override mandatory consumer rights.

8. Guarantor contact details

8.1.  Warranty provider: Facebike NL. Website: www.facebike.nl. Email: [email protected].

8.2.  Full registered business name and trading/correspondence address: [COMPLETE BEFORE ISSUE]. This commercial warranty applies to bicycles supplied by Facebike NL to consumers in the Netherlands. The invoice and sales documents identify the individual purchase.

9. Acknowledgement

9.1.  The buyer receives these terms at purchase on a durable medium or in a format that can be saved.

9.2.  The buyer is informed about the free first service (days 25–45), the paid annual services (€85 around year 1 and year 2), and that additional parts or services will be charged separately only after approval.

9.3.  Acknowledging these terms does not waive any statutory rights.
