Used electric bicycle – 6-month warranty.

WARRANTY TERMS FOR USED ELECTRIC BICYCLES

6 months e-bike, motor, controller and display | 1 month used battery

1. General provisions

1.1. Facebike NL provides an additional commercial warranty of six (6) months for a used electric bicycle purchased from our store. The used battery carries a separate additional commercial warranty of one (1) month. The motor, controller and display are covered by the six (6) month additional commercial warranty.

1.2. Warranty periods begin on the date the bicycle is actually delivered to the buyer. The separate commercial periods do not affect the buyer’s statutory rights.

1.3. The bicycle and battery are second-hand. Normal signs of use, cosmetic imperfections and wear consistent with age, previous use, price and the information given before purchase may be present.

1.4. The buyer has an opportunity to inspect the bicycle and, where practicable, take a test ride. Facebike NL discloses known defects and deviations before conclusion of the sale; specific deviations are separately and expressly agreed where required by law.

1.5. This commercial warranty is an additional promise and does not limit statutory conformity rights.

2. Coverage of the additional commercial warranty

2.1. For six months, Facebike NL will remedy, free of charge, defects affecting covered principal mechanical and electrical components that arise during normal, careful use and fall within this commercial warranty.

2.2. The electric drive motor, controller and display are covered by the six-month additional commercial warranty, except where damage is demonstrably caused by misuse, an external event, improper modification or normal wear.

2.3. For a covered defect, the free remedy includes the required parts and labour. Facebike NL will assess the problem and provide an appropriate remedy while respecting the buyer’s statutory rights.

2.4. The battery is subject only to the separate one-month commercial battery warranty described in Section 3; statutory rights remain applicable.

3. Used battery: performance and separate warranty period

3.1. The additional commercial warranty for the supplied used battery lasts one (1) month from delivery.

3.2. A used battery will normally have less available capacity and range than a new battery due to age, charging cycles and previous use. The buyer should not automatically expect the capacity, charging time, operating time or range of a new battery.

3.3. Actual range also depends on assistance level, temperature, tyre pressure, load, riding style, terrain and maintenance. A lower range consistent with the age and condition disclosed before purchase is not, by itself, a defect.

3.4. A battery defect covered by the additional warranty will be assessed free of charge within the one-month period and, if confirmed, appropriately remedied. Facebike NL may record a known capacity or deviation in writing before the sale.

3.5. Exclusions or expiry of the commercial battery warranty do not remove statutory rights if the battery fails to meet the expectations reasonably arising from the sale agreement.

3.6. Use only a compatible charger; follow charging instructions, avoid prolonged deep discharge, and do not charge or store a damaged, wet or abnormally hot battery until its safety has been checked.

4. Wear-and-tear parts and consumables

The additional commercial warranty does not include routine replacement or adjustment resulting from normal wear. Examples include:

4.1. Braking system

  • brake pads and normal wear of brake discs and rims;
  • brake cables, housings and adjustments required by normal use.

4.2. Drivetrain and gears

  • chain, cassette, freewheel and chainrings;
  • shift cables and normally worn shifting components.

4.3. Wheels and tyres

  • tyres, inner tubes, punctures and normal tread wear;
  • spoke tension adjustments and wheel truing necessitated by later use or external impact.

4.4. Other parts

  • grips, pedals and saddle covering to the extent affected by normal wear;
  • bulbs, replaceable accessory batteries, lubricants and other consumables.

These exclusions concern normal wear under the commercial warranty only. They do not limit statutory claims for goods that do not conform to the sales contract.

5. Water, moisture and storage of the e-bike

5.1. When not in use, the buyer should preferably store the electric bicycle indoors in a dry, enclosed and well-ventilated area. Avoid prolonged exposure to rain, standing water, extreme humidity and condensation.

5.2. The bicycle, battery, controller, display, connectors and charging points must not be submerged, pressure-washed or exposed to water contrary to manufacturer instructions.

5.3. Damage demonstrably caused by water ingress resulting from improper storage, submersion, pressure washing or other misuse is not covered by the additional commercial warranty.

5.4. Normal riding in rain, where the bicycle is designed for such use, does not automatically void the warranty. A defect caused by inadequate water resistance during reasonably expected normal use may be covered by statutory warranty rights.

5.5. Report moisture or water damage promptly. Switch off the electrical system and do not charge a possibly wet or damaged battery until its safety has been assessed.

6. Other exclusions from the commercial warranty

6.1. Defects demonstrably caused by a fall, collision, accident, overloading, use outside the bicycle’s intended purpose, or unqualified repair or modification after delivery are not covered.

6.2. Damage resulting from aggressive cleaners, unsuitable chargers, incorrect charging, prolonged inappropriate storage or external electrical incidents is also excluded to the extent it caused the fault.

6.3. Cosmetic deviations and signs of use specifically disclosed before purchase and validly accepted by the buyer are not covered by the additional commercial warranty.

6.4. No exclusion applies where mandatory Dutch consumer law nevertheless entitles the buyer to a free remedy.

7. First free service and maintenance responsibilities

7.1. Facebike NL offers a free initial inspection/service between the 25th and 40th calendar day after purchase. The buyer is requested to book in time and present the bicycle for inspection.

7.2. This inspection includes checks of brakes, gears, wheels, fasteners and the general operation of electric assistance. Routine replacement of worn parts is not automatically included free of charge.

7.3. Facebike NL treats this first service as part of the maintenance schedule associated with the additional commercial warranty. If a defect is demonstrably caused or worsened by failure to carry out necessary maintenance, this may affect commercial coverage for that defect.

7.4. Missing the service does not automatically remove statutory warranty rights and does not eliminate all commercial claims without a causal connection. If Facebike NL cannot provide an appointment within the stated period, another date will be agreed.

7.5. The buyer is responsible for ordinary maintenance, correct tyre pressure, regular checks of brakes and drivetrain, and careful treatment of electrical components.

8. Claims, assessment and repair

8.1. If a fault is discovered, the buyer should contact Facebike NL and preferably provide proof of purchase or order number, purchase date, a description and, where possible, photographs or video.

8.2. Facebike NL investigates the complaint and informs the buyer of the outcome. Where the commercial warranty or statutory conformity rights apply, the remedy is free of charge, including costs legally borne by the seller.

8.3. Only where a defect is not covered and no statutory claim applies may Facebike NL propose a paid repair. Chargeable diagnosis and repairs require the buyer’s prior consent.

8.4. A valid warranty issue will be resolved within a reasonable period and without significant inconvenience to the buyer, taking parts availability and legal obligations into account.

9. Statutory warranty and consumer rights

9.1. In addition to this commercial warranty, consumers have statutory rights under Dutch conformity law, including when purchasing used electric bicycles and used batteries.

9.2. Statutory conformity depends on factors including age, price, use, condition, information supplied, specific agreements and the features the buyer could reasonably expect.

9.3. Dutch law does not provide a single fixed statutory warranty period for every product. The six-month and one-month commercial terms do not restrict statutory rights.

9.4. Nothing in these conditions limits mandatory consumer rights.
